WHAT IS A MOBILE (TRAVELING) NOTARY PUBLIC?

For your convenience, I travel to notarize your documents at a mutually agreed upon location.(ie. home, eatery, coffee shop, place of employ, detention facility, hotel, hospital, hospice or Extended care facility.

WHAT IS A NOTARY PUBLIC?

A Notary Public is a government appointed public servant commissioned as an impartial witness in taking acknowledgments, administering oaths and affirmations, and performing other acts authorized by law, but not permitted to give any legal advice whatsoever. Unless a Notary Public is a licensed attorney, they may not give legal advice, draft legal documents nor accept fees for legal advice. A Notary may not even advise a client what type of notarization a document requires. The notarial wording must be provided by the creator of the document.

†††††††††† ~A NOTARY PUBLIC may refuse to sign or affix the seal to any document/s believed to be incomplete, fraudulent, the signer is under duress or the signer does not have proper identification.This helps protect against fraud and guarantees that certain requirements and standards have been met during the signing of the documents.

WHAT IS A LOAN SIGNING AGENT?

A Loan Signing Agent is a Notary Public who is specifically trained to facilitate the proper execution of Real Estate loan documents. Notary Signing Agents are hired as an independent contractor by mortgage, escrow and title companies, to authenticate the identity of the borrower, obtain the necessary signatures and notarizations, and return the documents to the lender. A signing agent is an impartial party to the transaction and must adhere to the notary laws of their state or jurisdiction.

~ The tasks of the Loan Signing Agent are vital to the successful closing and funding of the Real Estate transaction.Mortgage Lenders, Title Firms and Escrow Companies rely on competent Signing Agents to assist and witness the Borrowers in the signing, completing and then notarize portions of the Real Estate loan documents in a professional, reliable and accurate manner.

 

PREPARE FOR APPOINTMENT

DOCUMENTS

 

* HAVE YOUR DOCUMENTS AND IDENTIFICATION AT HAND. ALL SIGNERS MUST HAVE VALID PHOTO ID.

* DO NOT sign the documents beforehand when your signing is to be witnessed and notarized.

* A Notary Public may not accept any acknowledgment or proof of any instrument that is incomplete.

* All documents to be notarized must be completed without any blanks, incomplete fields or back-dated.

* All document pages to be notarized must be available at the time of signing.

* If the documents are part of a Loan Package, please keep in the same STACKING order as received.

* Some documents must be signed in the presence of the Notary and others are to verified under oath.††††††††††††††††††††††††††††††††††††††

IDENTIFICATION (ALWAYS REQUIRED FOR ALL SIGNERS)†††††††††††††††††††††††††††

* You must show a valid government ID which is current, or has been issued within the past 5 years [Civil Code Section 118(c)(3)&(4)].

* Identification must have a photograph, description, signature, and an identifying number.

* Two credible witnesses with current, valid Government ID who personally know the signer in the case that the document signer lacks ID.

* NOTE: The credible witnesses cannot be named in the document and cannot have financial interest in the document. Both credible witnesses MUST have proper ID and take an Oath to knowing the signer.

 

ACCEPTABLE FORMS OF IDENTIFICATION INCLUDE:

*An identification card or driver's license issued by the California Department of Motor Vehicles.

*Other California state-approved identification card provided that it contains a photograph, description and signature of the person, and an identifying number.

*A driver's license issued by another state or by a Canadian or Mexican public agency authorized to issue a driver's license.

*An identification card issued by another state provided that it contains a photograph, description and signature of the person, and an identifying number.

*A U.S. passport issued by the State Department of the United States.

*A passport issued by a foreign government.

*A military identification card issued by any branch of the armed forces of the United States.

*An inmate identification issued by the California Department of Corrections, if the inmate is in custody.

*Two credible witnesses that personally know the signer in the case that the document signer lacks ID.

 

NOTE: The credible witnesses cannot be named in the document and cannot have financial interest in the document.

Can I get a document notarized over the phone?

All signers and witnesses must personally appear before the Notary Public to have a document notarized.

 

May I assist another person sign a document for notarization?

Signers may not be assisted by anyone during the signing process. The signer must be able to sign or make their mark independently.

 

How can someone who is illiterate or unable to write get a document notarized?

If a person is illiterate or unable to write but is able to make a mark, the State of California allows such notarizations via "Signature by Mark." Proper ID must be made available to the Notary Public.†††††††††††††††††††††††††††††††††

 

May my notary assist or advise me on completing a document?

Notaries are not lawyers and are prohibited from giving any legal advice.

 

If I am sedated and/or incoherent, may I still get a doc notarized?

The Notary must make a judgment call in determining if you are aware and capable of making a decision to sign and that you are not under the control of any substance or duress that would cause you to sign something that you normally would possibly not sign.

Usually, all extenuating circumstance during a signing are indicated in the Notary's journal.

 

May I use my expired U.S. driver's license as ID?

You may use your expired U.S. driver's license to establish your identification provided it has not been 5 or more years since it was issued.

 

Can any driver's license be used as ID for notarization?

††††††††† Only driver's licenses from the U.S., Canada and Mexico are valid for establishing notarization ID in California.††††††

 

What if the name on the document is similar to the name on my identification but doesn't quite match?

Notaries follow the "less but not more rule." For example, if the identification reads "John Robert Smith" the Notary may accept the signature, "John Smith", "John R. Smith" or "J. Smith."

However, the Notary may not accept more of a name than appears on the identification. For instance, the Notary may not accept the signature "John Robert Smith" if the identification reads "John R. Smith."

What is an Acknowledgment?

An Acknowledgment is a certificate completed by the notary according to Civil Code section 1189, wherein:

(a)  The signer personally appeared before the notary on the date and in the county indicated and acknowledged executing the document††† being†† Acknowledged, willingly and knowingly.

(b)The notary signed and affixed his/her seal on the Acknowledgment, and

(c)The notary properly identified the signer.

(d)The wording of the Acknowledgment must read:

 

 

 

A notary public or other officer completing this certificate verifies only the identity of the individual who signed the document to which this certificate is attached, and not the truthfulness, accuracy, or validity of that document.

Can I get an Acknowledgment for a doc that is not currently in my possession?

Acknowledgments may only be executed for documents you (or Subscribing Witness) personally bring to the notary.

 

What is a Jurat?

A Jurat is a certificate completed by the notary according to Government Code Section 8202, wherein:

(a) The signer personally appeared before the notary on the date and in the county indicated.

(b) The signer signed the document in front of the notary.

(c) The notary administered the oath or affirmation.†††††††††††

(d) The notary signed and affixed his/her seal on the Jurat.

(e) The notary properly identified the signer.

 

The wording of the Jurat must read:

Why does the notary sometimes staple a Jurat or Acknowledgment form to my document?

Your notary will staple your Acknowledgment or Jurat form to the back of your document being notarized if the notarization statement of your document does not comply with approved California Notary wording.††††††††††

 

Can I get a document notarized if I have lost my ID or am unable to immediately obtain it?

You are still able to have your documents notarized if you do not have the proper identification on your person and the Notary has either

(a) Two credible witnesses who swear (or affirm) to personally knowing each other with one personally knowing the person they are ††††††††††† representing.

(b) One credible witness who swears (or affirms) to personally knowing the person they are representing and whom the Notary personally knows.††††††††††††††††††††††††††††††††††† †††††††††††††††††††††††

 

Do I still need to provide ID if the notary knows me personally?

Your identity must be verified by satisfactory evidence, whether or not you are personally known by the Notary.

 

What is "Satisfactory Evidence?"

(a) Satisfactory Evidence means the verification of a personís photo ID containing their address, full physical description and Government ID number.

(b) The oath of a single credible witness personally known to the notary, or

(c) The oath of two credible witnesses.

 

What is a "Credible Witness?"

A Credible Witness is a person (whose identity has been established by the Notary according to Satisfactory Evidence) who personally knows and establishes the identity of another person via oath.

(The Notary has to personally know the Credible Witness if he/she is validating the identity of a person with only one Credible Witness.)

Must I personally appear before the notary to get a document notarize? ††††††††††††††††††††††††††††††††††††††

Unless you are using a Subscribing Witness, you must personally appear before the notary.

 

What is a "Subscribing Witness?"

A Subscribing Witness is a person who appears on behalf of another person, the principal, to prove the principal signed the document. There are many requirements attached to this type of witness.

One major requirement is the identity of the Subscribing Witness must be established by the oath of a credible witness whom the notary personally knows and who personally knows the subscribing witness. This type of witness is not to be used for a Quitclaim Deed, Grant Deed (other than a Trustee's Deed or Deed of Reconveyance), Mortgage, Deed of Trust or Security Agreement.

 

May I sign my documents in advance before the notary arrives?

You may sign your documents in advance if they only require an Acknowledgment. The notary will ask you to acknowledge that the signatures on the docs are indeed yours.

However, all docs requiring a Jurat or thumb print must be signed in front of the Notary.†††††††

 

Which documents require a thumb print?

Documents for which a mandatory thumb print must be obtained are: Deed, Quitclaim Deed, Deed or Trust affecting Real Property, Power of Attorney and Affidavits.

 

How may I get a Certified Copy of a Power of Attorney?

You may obtain a Certified Copy of a Power of Attorney by presenting the original Power of Attorney to a California Notary Public for certification.

What is Power of Attorney?††††††††††††††††††††††††††††††††††††††

A Power of Attorney is a document under which you as the "Principal," give legal permission to another person or entity

††††††††††† (an "Attorney-in-Fact" or "Agent") to act on your behalf.††††

You sign a Power of Attorney document so that your Agent will be able to handle your affairs during a period of time when you are unavailable or unable to do so. An Agent is not required to be a lawyer.††††

A Power of Attorney may be either general or specific. A General Power of Attorney gives the Agent broad authority to act for you.††††

A Special Power of Attorney grants the agent limited authority to act only in specified situations. (ie: Banking, Health, Real Estate, and Incarceration)

 

What is Durable Power of Attorney?

††††††††††† You may create a FINANCIAL "Durable" Power of Attorney, which means it will remain in effect even if you become incompetent or incapable of handling your affairs. If you do not want the Power of Attorney to remain in effect during these times, then the document can be made "non-durable."

 

††††††††††† Note: POWER OF ATTORNEY is a legal instrument authorizing one to act as another's agent or attorney. The person who authorizes another to be their agent is the grantor, while the person receiving authorization is the 'Attorney in Fact'. The Attorney in Fact can sign documents as follows. If the Attorney in Fact is Sue, and the Grantor of the Power of Attorney is Mark, she can sign, "Sue, as Attorney in Fact for Mark". Or, "Mark, by Sue, his Attorney in Fact."††††††††††

††††††††††† Powers of Attorney require being notarized and the type of notarization wording is generally Acknowledgment Certificate wording. Signers of Powers of Attorney are often incarcerated or elderly people. Signers meeting these descriptions don't always have current ID or any identification at all.The Signers must understand what they are signing to deter fraud from happening.

 

††††††††††† There are various types of Power of Attorney documents:

(A) One type of Power of Attorney is a Health Care (AHCD) Power of Attorney which authorizes the attorney in fact to make health care decisions for the grantor.

††††††††††† (B) There are Real Estate Powers of Attorney that authorize the agent to manage properties.

††††††††††† (C) Many Banks have their own Power of Attorney form so that a relative of a hospitalized person can handle their banking transactions.

(D) A Power of Attorney is the one document that a notary can make a certified copy of according to California notary law. Many stationary stores have standardized

What is an Affidavit?

††††††††††† An Affidavit is a sworn statement that is notarized.††††††††

 

What is a U.S. Department of State Authentication?

This is a certification issued by the U.S. Department of State, authenticating the signature of the federal official who signed the document (ie: birth certificate, marriage license, death certificate) and the capacity in which that official acted, or the signature of the signer of a state apostille.

 

What is a California Apostille?

††††††††††† A California Apostille is a certificate issued by the Office of the Secretary of State of the State of California, authenticating the signature of the California official who signed the document and the capacity in which that official acted.

††††††††††† Authentication is limited to the signatures of Notary Publics, County Clerks or Recorders, Court Administrators of the Superior Court, Officers whose authority is not limited to any particular county, Executive Clerks of the Superior Court, Executive Officers of the Superior Court, Judges of the Superior Court and State Officials.
